⚠ Document Preparation Disclaimer
Semper Facilis provides trademark search and application document preparation as an administrative service only. This is not legal advice and we are not acting as your legal representative before the USPTO. A preliminary knockout search does not replace a comprehensive clearance opinion from a licensed trademark attorney. Members with complex marks, color/design trademarks, likelihood-of-confusion concerns, or existing oppositions are directed to retain a licensed trademark attorney for full counsel. USPTO applications are filed on your behalf — you are the applicant of record.

What's Included

How does the trademark process work?

Preliminary Knockout Search
We search the USPTO's TESS database and common-law sources to identify marks that are identical or confusingly similar to yours in the same or related classes. Obvious conflicts are flagged before you pay a filing fee. Note: this is not a comprehensive legal clearance — a trademark attorney can provide a full opinion.
Application Preparation
We prepare your USPTO trademark application, including mark description, goods/services identification, international class selection, applicant information, and basis (use in commerce or intent to use). We also guide you on specimen requirements if you're filing based on current use. The USPTO filing fee is $350/class base (effective January 2025), billed separately at cost.
Submission Coordination
We coordinate filing via the USPTO TEAS portal and deliver the serial number and filing receipt to your document vault. The mark enters the examination queue — typical USPTO review is 8–12 months from filing date.
What Happens After Filing
USPTO will examine the application and may issue an Office Action requesting clarification or refusing registration. Responding to Office Actions is legal work — members who receive an Office Action are directed to retain a licensed trademark attorney for the response. We can refer you to our referral network if needed.
