1. Who We Are

Semper Facilis PMA ("Semper Facilis," "we," "us," or "our") is a Private Membership Association based in Phoenix, Arizona. We operate the website at semperfacilis.com and related member services. Questions about this policy may be directed to info@semperfacilis.com.

2. Information We Collect

We collect information you provide directly to us, including:

• Name, email address, phone number, and mailing address
• Account credentials (email and hashed password)
• Payment information (processed through third-party payment processors — we do not store card numbers)
• Business information provided during intake, service ordering, or support requests
• Communications you send to us (email, contact form, support tickets)

We also collect certain information automatically when you visit our website:

• Log data (IP address, browser type, pages visited, referring URLs)
• Device information
• Cookies and similar tracking technologies (see Section 6)

3. How We Use Your Information

We use the information we collect to:

• Provide, operate, and maintain our services
• Process transactions and send related information
• Send service-related communications (account confirmation, document delivery, compliance reminders)

4. Information Sharing

We do not sell, trade, or rent your personal information to third parties. We may share information with:

• Service providers: Third-party vendors who assist in operating our website and delivering services (hosting, email delivery, payment processing). These providers are contractually bound to protect your information.
• Legal requirements: If required by law, subpoena, or other legal process, or if we believe disclosure is necessary to protect the rights, property, or safety of Semper Facilis, our members, or the public.
• Business transfers: In connection with a merger, acquisition, or sale of assets, with appropriate confidentiality protections.

5. Giveaway and Sweepstakes Data

If you enter the Monthly Website Giveaway — either free or with a Website Launch Blueprint purchase — we collect your name, email address, city and state, whether you currently have a website, and optionally your phone number, business name and website address. We use it to run the drawing, to contact you if you win, to deliver anything you purchased, and to prepare your Personalized Website Snapshot.

Two consents are collected separately on the entry form, and both are optional and unchecked by default:

• Marketing email. We send website tips and offers only if you tick that box. You can unsubscribe from any such email.
• Calls and text messages. We call or text you about your website only if you tick that box specifically. Agreeing to marketing email is not agreement to be called or texted.

Neither consent is required to enter the drawing, to win, or to buy anything, and you can withdraw either at any time by replying STOP to a text, unsubscribing from an email, or writing to info@semperfacilis.com. We record which version of the consent wording you agreed to and when, so that rewording it later does not change what you actually agreed to.

We also record the IP address, browser user agent, referring page and any campaign tags present when an entry is submitted. That is used to detect duplicate and automated entries, which is what makes the one-entry-per-person limit enforceable, and for nothing else.

Entry records are retained for at least twelve months after the drawing they relate to. Sweepstakes records have to be kept long enough to substantiate how a drawing was conducted if it is questioned, and the Official Rules allow six months for anyone to request the winner’s name. If you ask us to delete your data, we will remove it from marketing use immediately; we may retain the minimum record of the entry itself for that period, and we will tell you if that applies to you.

If you win, we additionally collect the information needed to award the prize — including an IRS Form W-9, which contains your taxpayer identification number. That is used to issue the Form 1099-MISC the law requires and is retained as long as tax law requires. We do not use it for anything else.

We do not sell giveaway entrants’ information. See the Official Rules for how the drawing itself works.

6. Data Retention

We retain your personal information for as long as your membership is active and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated data by contacting us at info@semperfacilis.com. Certain information may be retained for legal or compliance purposes even after account deletion.

7. Cookies

We use cookies and similar tracking technologies to enhance your experience, analyze site usage, and deliver relevant content. You may control cookies through your browser settings. Disabling certain cookies may affect the functionality of our member portal.

8. Security

We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Passwords are stored using bcrypt hashing. No method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights

You may request access to, correction of, or deletion of your personal information by contacting us. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA). Contact us to exercise any applicable rights.

10. Children

Our services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected such information, please contact us immediately.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify members of material changes by email or through the member dashboard. Continued use of our services after the effective date of the revised policy constitutes acceptance.
